Kenya: 3 Ask Supreme Court to Stop Poll

Raila Odinga calls for fresh demonstrations

KENYAN police used bullets and tear gas on Tuesday to disperse a small demonstration in Nairobi two days before elections, as the main opposition leader appeared to row back from a call for his supporters to hold protests during the vote.

Mwilu's driver, identified by local media as Police Constable Titus Musyoka and in some reports described as a bodyguard was shot in the shoulder.

The Supreme Court later annulled the poll results and ordered a repeat election, citing irregularities.

In the western city of Kisumu, around 2,000 demonstrators marched on the election board offices, witnesses said, responding to Raila Odinga's appeal for protests against Thursday's repeat presidential ballot.

The court hearing will occur even though Kenya's interior ministry has declared Wednesday and Thursday to be public holidays.

Justice Chacha Mwita on Tuesday afternoon ruled that issues raised by Pokot South MP David Pkosing fall under the jurisdiction of the Supreme Court.

The top court, whose surprise decision to annul the August 8 election over irregularities set the stage for this week's new vote, said it will convene Wednesday morning to hear petitioners who allege that Kenya's electoral commission is in disarray and prone to political interference.

This comes as the country is divided in opinion over the current political situation where NASA leader Raila Odinga says there shall be no election while President Uhuru Kenyatta has insisted that there shall be an election.

IEBC commissioners, they argue, are serving partisan interests and Chairman Wafula Chebukati has publicly admitted that he can not guarantee credible election.

"We have not told people to demonstrate on polling day, we have not said that at all".

Khalifa said the three want elections postponed until the electoral commission can deliver a credible vote.

A police officer told The Associated Press that he and his colleagues were firing blanks.

Tensions have been mounting in the East African country ahead of the poll rerun, with nearly daily mass protests and foreign diplomats warning a fair election can not be guaranteed.
